Sexual Assault and the Law
Sexual assault is an offence under Section 3 of the Sexual Offences Act 2003.
By law, sexual assault occurs when a person intentionally touches another person sexually without consent and without a reasonable belief in consent.
- Any intentional sexual touching of another person without consent.
- Acts where consent is obtained through coercion or intimidation.
- Situations where the alleged victim lacks capacity to consent due to age, intoxication or mental condition.
- Intentionally touched the complainant in a sexual manner.
- Did so without their consent.
- Did not reasonably believe that consent was freely given.
