With a team experienced in serious and complex crime, Ashmans Solicitors are here to assist, whether:

- You wish to vary or discharge an existing SCPO
- You’re accused of breaching the terms of an SCPO and require immediate strategic defence
With Ashmans, you never need to feel alone. We stand firmly in your corner at every stage, protecting your rights and challenging disproportionate or unjustified restrictions.
Serious Crime Prevention Orders and the Law
Serious Crime Prevention Orders (SCPOs) are civil orders made under the Serious Crime Act 2007. They are designed to prevent, restrict or disrupt involvement in serious crime. An application can follow a conviction for a serious offence, or be made in the High Court where the court is satisfied that an individual has been involved in serious crime and that an order would protect the public.
- Restrictions on financial, property or business dealings
- Limitations on associations, communications or travel
- Obligations to provide information, documents or access to digital devices
- The respondent has been involved in serious crime (whether in England and Wales or elsewhere).
- There are reasonable grounds to believe the order would protect the public by preventing, restricting or disrupting further serious crime.
- The proposed terms are proportionate and no wider than necessary.
Breach of an SCPO is a criminal offence and can result in imprisonment, a fine, or both. Applications and enforcement action may involve agencies such as the National Crime Agency, Serious Fraud Office, HM Revenue & Customs or other specialist prosecutors, often supported by detailed financial, digital and surveillance evidence.
Essential actions against accusations
From the moment you are notified of a Serious Crime Prevention Order (SCPO) application, proposed variation, or alleged breach, your response can significantly affect the outcome. Early, strategic legal action is critical. Take our advice and follow these steps:
Act decisively, instruct Ashmans, safeguard your future.
An SCPO can impose strict and intrusive conditions. Failing to respond properly may result in an order being made in wide terms without challenge.
Even if the proposed restrictions seem manageable, they may have serious long-term consequences. Always seek specialist advice before consenting to any order or variation.
With 24/7 availability, Ashmans is ready to provide urgent representation in the Crown Court or High Court, protecting your liberty and livelihood from the outset.
Keep documentation, financial material and communications that may demonstrate compliance, proportionality concerns, or rebut allegations of involvement in serious crime.
If an SCPO is already in place, follow its terms carefully. An alleged breach is a criminal offence and must be defended strategically and without delay.
