Threats to Kill Defence Specialists
Threats to kill allegations can stop you in your tracks: overwhelmed with the stress, fear and uncertainty you’re facing. With the risk of immediate arrest, strict bail conditions, a criminal record or even a custodial sentence, securing a strong defence is essential from the outset.
Under section 16 of the Offences Against the Person Act 1861, it is an offence to make a threat to kill intending that the person receiving the threat would fear it would be carried out. These cases often arise in emotionally charged domestic situations and can quickly escalate into serious criminal proceedings. With a team of skilled domestic offence specialists, Ashmans Solicitors are here to assist, whether:
- You’re under investigation or facing charges for threats to kill
- You want to protect your rights and ensure a fair legal process
- You want a strategic legal defence from a strong yet sensitive team of experts
With Ashmans, you never need to feel alone. We’re in your corner at every stage, fearlessly fighting for the best possible outcomes.
Threats to Kill and the Law
Under Section 16 of the Offences Against the Person Act 1861, “a person who, without lawful excuse, makes a threat to kill another, intending that the other would fear it would be carried out,” commits a serious criminal offence.
- Verbal or written statements expressing an intention to cause death.
- Electronic communications such as texts, emails, or social media messages.
- Conduct implying a credible intent to kill, even if no weapon or plan exists.
- Made a clear threat of death to another person.
- Intended the victim to believe that the threat would be carried out.
- Had no lawful excuse or justification for making the statement.
Investigations are often led by agencies such as the Crown Prosecution Service (CPS), police domestic abuse units, and, where relevant, HM Courts & Tribunals Service (HMCTS). Evidence may include witness statements, mobile phone records, social media data, and digital forensic material.
Because the charge carries a maximum penalty of 10 years’ imprisonment, specialist representation is vital from the moment of arrest.
