Harassment & Stalking

Harassment is defined under the Protection from Harassment Act 1997 as a course of conduct (usually at least two incidents) which causes another person alarm or distress. This can include repeated messages, unwanted contact, following someone, or other behaviour that amounts to oppressive or unreasonable conduct.

Stalking is a specific form of harassment involving fixated, obsessive, unwanted and repeated behaviour, such as following someone, monitoring their online activity, or repeatedly contacting them. Stalking offences were introduced under the Protection of Freedoms Act 2012 and can carry more serious penalties, particularly where fear of violence or serious alarm and distress is alleged.

Penalties can include fines, community orders, restraining orders and imprisonment. More serious stalking offences (including those involving fear of violence or serious alarm and distress) can result in custodial sentences of up to 10 years, depending on the circumstances of the case.
