Domestic Assault and the Law
Under England and Wales law, domestic assault (often charged as common assault) falls under section 39 of the Criminal Justice Act 1988. It involves intentionally or recklessly causing another person to fear immediate unlawful violence or making physical contact without consent. When the alleged victim is a partner, ex-partner, or family member, the matter is treated as a domestic offence, carrying heightened scrutiny.
- Any act where unlawful force is used or threatened.
- An action causing fear of immediate violence, even without physical injury.
- Minor injuries such as scratches, bruises, or redness can suffice.
- Acted intentionally or recklessly to cause harm or fear.
- Had no lawful excuse or self-defence justification.
- Was responsible for the act beyond reasonable doubt.
Agencies such as the Crown Prosecution Service (CPS), police, and sometimes Social Services may be involved. Evidence may include body-worn footage, 999 recordings, medical reports, and text or social media messages.
