Assault by Strangulation

Assault by strangulation or suffocation is an offence under section 75A of the Serious Crime Act 2015 (as amended). It involves intentionally strangling another person or doing any other act that affects their ability to breathe, such as covering their mouth or nose, in the context of domestic abuse. Visible injury is not required for the offence to be made out.

Assault by strangulation is an either-way offence and carries a maximum sentence of up to 5 years’ imprisonment. The court will consider factors such as the level of harm, intent, previous convictions and whether the offence forms part of a wider pattern of domestic abuse.
