Unauthorised Computer Access and the Law.
Under section 1 of the Computer Misuse Act 1990, it is a criminal offence to cause a computer to perform any function with intent to access data without authorisation. The Act applies to all digital devices from personal computers and mobile phones to servers and online databases.
- Accessing a computer system without permission.
- Causing a system to perform a function to obtain or modify data.
- Doing so intentionally and knowing authorisation is absent.
- Caused a computer to perform a function with the purpose of accessing data.
- Knew or believed the access was unauthorised.
- Acted intentionally rather than accidentally.
Investigations are often led by the National Crime Agency (NCA), Crown Prosecution Service (CPS), and specialist cyber units of police forces. Depending on the case, HMRC, FCA, or the Serious Fraud Office (SFO) may also become involved if there are links to financial or corporate offences.
Evidence commonly examined includes server logs, device forensics, IP addresses, metadata trails, and communications data. Our lawyers experienced in Computer Misuse Act cases ensure that digital evidence is challenged and that no unlawful investigative method is overlooked.
