Trading Standards departments prosecute a broad range of offences under legislation such as the Consumer Protection from Unfair Trading Regulations 2008, the Trade Marks Act 1994, the Fraud Act 2006, the Food Safety Act 1990 and other regulatory laws. Allegations commonly involve counterfeit goods, misleading advertising, unsafe or non-compliant products, pricing breaches and unfair commercial practices.

Penalties depend on the seriousness of the offence and whether the case is heard in the Magistrates’ Court or Crown Court. They may include unlimited fines, confiscation proceedings under the Proceeds of Crime Act 2002, director disqualification, forfeiture of goods, compensation orders and, in serious cases, imprisonment.
