Overview
This case involved a £2.6 million VAT fraud investigated and prosecuted by SOCA (Serious Organised Crime Agency). We successfully defended a company director accused of taking part in a conspiracy to defraud HMRC. After a 10-week trial, and despite the significant evidence against our client, the jury delivered a unanimous ‘not guilty’ verdict.
This case highlighted our expertise in securing justice in complex financial crime cases.
The Allegations
Our client was charged with Conspiracy to Cheat HMRC as part of a large-scale VAT fraud involving nearly 20 companies who were alleged to have been abusing the zero-rated VAT reclaims system for new-build properties. The Prosecution argued that our client’s company submitted some of the largest fraudulent VAT reclaims, backed by false invoices and regular calls to HMRC.
The allegations carried severe penalties and required an expert understanding of financial regulations and legal principles.

The Challenges
This case presented multiple challenges, including:
- The vast and complex body of evidence comprising over 23,000 documents
- The Prosecution’s focus on our client’s company as being vital to the alleged conspiracy
- The difficulty of separating our client from fraudulent activities allegedly conducted by his company.
These challenges required a stanch commitment to detail and strategic planning to ensure a fair trial.

The Result
After a 10-week trial and nearly five days of jury deliberation, our client was found ‘not guilty’ of Conspiracy to Cheat HMRC.
This outcome not only brought justice to our client, but also demonstrated the critical role that expert legal representation plays in complex financial crime cases.
