Under England & Wales law, the primary legislation is the Animal Welfare Act 2006. This Act makes it an offence to cause unnecessary suffering to any protected animal or to fail to meet its basic welfare needs.
- Causing unnecessary suffering to an animal, whether deliberate or through neglect
- Failing to provide adequate food, water, shelter, or veterinary care.
- Involvement in organised cruelty such as fighting, baiting or mutilation.
- Was responsible for the animal at the relevant time.
- Knew, or ought reasonably to have known, that the animal was suffering or neglected.
- Failed to take reasonable steps to prevent or stop the suffering.
Investigations may involve the RSPCA, Crown Prosecution Service (CPS), local authorities, or occasionally the Police and Animal Plant Health Agency (APHA).
Evidence often includes veterinary reports, witness statements, photographs, CCTV, and expert assessments of animal condition. Cases can also include linked offences under the Animal Welfare (Sentencing and Recognition of Sentience) Act 2021, which increased penalties to up to five years’ imprisonment for the most serious cases.
