Assault by Penetration and the Law
Under Section 2 of the Sexual Offences Act 2003, assault by penetration is a serious indictable offence, carrying a potential maximum sentence of life imprisonment.
- Intentional penetration of the vagina or anus of another person with a part of the body or an object.
- The act must be sexual in nature.
- The complainant must not have consented, and the defendant must not reasonably believe that consent was given.
- Intentionally carried out the act of penetration.
- Knew or could not reasonably believe that the complainant consented.
- Acted for sexual gratification or in a sexual context.
Investigations may involve multiple agencies such as the Crown Prosecution Service (CPS), Serious Crime Units, Digital Forensics Teams, and sometimes the National Crime Agency (NCA) or Social Services if minors are involved.
Evidence can include, Forensic and DNA analysis. Digital messages, social media data, and CCTV footage. Witness testimony and previous conduct assessments. A charge of this gravity demands an immediate, specialist legal response.
