Driving Whilst Disqualified and the Law
Under section 103(1) of the Road Traffic Act 1988, it is an offence for a person who is disqualified from driving to drive a motor vehicle on a road or public place.
- Driving a motor vehicle while subject to a court-imposed disqualification.
- Allowing another disqualified person to drive your vehicle.
- Being in control of a vehicle while knowing you are banned.
- Was driving or in charge of a motor vehicle on a public road.
- Was disqualified from holding or obtaining a driving licence at the time.
- Knew or ought reasonably to have known about the disqualification.
Agencies such as the Crown Prosecution Service (CPS), police, and DVLA work together during investigations. In more serious or repeat cases, the CPS Specialist Traffic Unit or Serious Fraud Office (if linked to document fraud) may become involved.
Evidence often includes DVLA records, police body-worn video, witness testimony, and prior court orders. An admission or misunderstanding about licence reinstatement can have serious consequences, but skilled defence solicitors can challenge procedural errors or lack of knowledge.
Conviction may result in imprisonment (up to 6 months), a further disqualification, community service, or substantial fines. A conviction is recorded on your criminal record, impacting employment, insurance, and immigration status.
