Domestic Assault (ABH)

Domestic assault causing Actual Bodily Harm is an offence under section 47 of the Offences Against the Person Act 1861. It involves an assault or battery that results in injuries more than minor or transient, such as bruising, cuts or psychological harm. Where the allegation involves a partner, ex-partner or family member, it is treated as a domestic offence.

ABH is an either-way offence and can be heard in the Magistrates’ Court or Crown Court. The maximum sentence in the Crown Court is five years’ imprisonment. Sentences depend on the seriousness of the injury, the circumstances of the incident and any aggravating or mitigating factors.
