DVPO Defence Specialists
Being served with a Domestic Violence Protection Notice (DVPN) or facing a Domestic Violence Protection Order (DVPO) can stop you in your tracks: overwhelmed by the shock, confusion and uncertainty of what happens next. With the risk of being removed from your home, prohibited from contacting a partner or family member, or facing arrest and criminal prosecution for breach, securing strong legal representation from the outset is essential.
With a team of skilled domestic offence specialists, Ashmans Solicitors are here to assist, whether:
- You’ve been served with a DVPN and must attend a Magistrates’ Court hearing for a DVPO
- You’re subject to a DVPO and need advice on your rights, conditions and next steps
- You’re accused of breaching a DVPO and are facing arrest or prosecution
With Ashmans, you never need to feel alone. We’re in your corner at every stage, protecting your rights and challenging orders that are unnecessary, disproportionate or unjustified.
DVPO and the Law
Under the Crime and Security Act 2010, police can apply for a Domestic Violence Protection Notice (DVPN) followed by a Domestic Violence Protection Order (DVPO), granting temporary restrictions to protect alleged victims of domestic abuse.
- Prohibition from contacting or approaching the alleged victim.
- Exclusion from a shared residence.
- Restrictions on visiting specific locations.
- Was properly served with the notice or order.
- Engaged in behaviour or contact breaching its terms.
- Acted knowingly or recklessly in disobeying the court’s directions.
Agencies involved may include the Crown Prosecution Service (CPS), police Domestic Violence Units, and the courts. In more complex cases, the National Crime Agency (NCA) or local safeguarding boards can contribute evidence.
Evidence often includes witness statements, police body-worn footage, text or call records, and social media activity.
Breaching a DVPO is a civil contempt of court offence that may result in immediate custody. Our domestic offence lawyers meticulously analyse every aspect to challenge inconsistencies and secure fair representation under England & Wales law.
Essential actions against accusations
From the moment a Domestic Violence Protection Notice (DVPN) is served or a Domestic Violence Protection Order (DVPO) is applied for, your actions can directly influence the outcome of your case. Whether you are facing a Magistrates’ Court hearing or an allegation of breach, taking immediate and informed steps is critical. Take our advice and follow these steps:
Act quickly. Engage Ashmans. Protect your home, your reputation and your future.
Do NOT contact the complainant directly or indirectly, and do not attempt to “resolve” matters yourself. Any communication including messages sent through third parties or social media can be relied upon in court and may amount to a breach.
If you are required to attend a DVPO hearing, or if you are arrested or invited for interview regarding an alleged breach, do NOT provide statements without your solicitor present. Even informal explanations can affect your defence.
DVPO hearings are listed quickly, often within 48 hours of a DVPN being issued. Early representation allows us to prepare your case, challenge evidence and protect your position from the outset. With 24/7 availability, Ashmans is ready to provide urgent legal support.
Keep messages, call logs, CCTV footage, location data or witness details that may assist your defence. Do not delete anything, even if you believe it is unimportant.
Until varied or discharged by the court, a DVPO must be followed precisely. Breach can result in arrest and prosecution. Leave strategy and variation applications to your legal team.
