DVPO Defence Specialists
A domestic violence protection order can be imposed quickly and without warning, leaving you facing immediate restrictions, exclusion from your home, and reputational harm, often before you have had a full opportunity to present your side of the story. The stakes are high, and the consequences can affect your family life, employment, and future.
With a team of skilled domestic offence specialists, Ashmans Solicitors are here to assist, whether:
- You’re facing an urgent domestic abuse order and unsure what happens next.
- You want to challenge the evidence and avoid unnecessary restrictions.
- You need specialist DVPO defence lawyers to protect your position.
With Ashmans, you never need to feel alone. We’re in your corner at every stage, protecting your rights and challenging orders that are unnecessary, disproportionate or unjustified.
DVPO Defence and the Law
Under the Crime and Security Act 2010, police can apply for a Domestic Violence Protection Notice (DVPN) followed by a Domestic Violence Protection Order (DVPO), granting temporary restrictions to protect alleged victims of domestic abuse.
- Prohibiting contact with the alleged victim, including indirect communication and presence at specific locations
- Excluding the individual from their home or shared residence, regardless of ownership or tenancy rights
- Imposing conditions designed to prevent further alleged harm or risk
- There are reasonable grounds to believe the individual has been involved in domestic violence
- The order is necessary to protect the alleged victim from further harm or risk
- The restrictions imposed are proportionate and justified based on available evidence
Investigations and applications may involve police forces, with cases presented before Magistrates’ Courts, relying on statements, body-worn footage, call logs, and risk assessments.
Breaching a DVPO is a civil contempt of court offence that may result in immediate custody. Our domestic offence lawyers meticulously analyse every aspect to challenge inconsistencies and secure fair representation under England & Wales law.

Essential actions against accusations
From the moment a Domestic Violence Protection Notice (DVPN) is served or a Domestic Violence Protection Order (DVPO) is applied for, your actions can directly influence the outcome of your case. If you are facing an allegation of breach, taking immediate and informed steps is critical. Take our advice and follow these steps:
Act quickly. Engage Ashmans. Protect your home, your reputation and your future.
Do NOT contact the complainant directly or indirectly, and do not attempt to “resolve” matters yourself. Any communication including messages sent through third parties or social media can be relied upon in court and may amount to a breach.
If you are required to attend a DVPO hearing, or if you are arrested or invited for interview regarding an alleged breach, do NOT provide statements without your solicitor present. Even informal explanations can affect your defence.
DVPO hearings are listed quickly, often within 48 hours of a DVPN being issued. Early representation allows us to prepare your case, challenge evidence and protect your position from the outset. With 24/7 availability, Ashmans is ready to provide urgent legal support.
Keep messages, call logs, CCTV footage, location data or witness details that may assist your defence. Do not delete anything, even if you believe it is unimportant.
Until varied or discharged by the court, a DVPO must be followed precisely. Breach can result in arrest and prosecution. Leave strategy and variation applications to your legal team.
